GENERAL TERMS AND INFORMATION ABOUT THE PROVIDER
The general conditions of the Floramicato online store are composed in accordance with the Code of Obligations of the Republic of Slovenia, the Consumer Protection Act, the recommendations of the Chamber of Commerce and Industry and international e-business codes.

The general conditions determine the operation of the online store and the rights and obligations of the user and the provider. When placing an order, the user/buyer is each time specifically reminded of the general terms and conditions and confirms his familiarity with them by placing the order.
A user is a person who uses our website, a buyer of an online order. The buyer (customer, user, consumer) is a natural or legal person who orders products on the Floramicato website. The customer is bound by the general conditions that are valid at the time of placing the online order.
COMPLAINTS AND DISPUTES
Floramicato d. o. o. complies with applicable consumer protection legislation. Floramicato d. o. o. is doing its best to fulfill its duty to establish an effective complaint handling system. The complaint can be written on e-mail address email@example.com or to to the provider’s post address, which can be seen on the provider’s website. The appeal process is confidential. Floramicato d. o. o. does its best to resolve any disputes amicably or with an out-of-court settlement, but if this is not possible, disputes will be resolved by the actual court in Ptuj.
OUT OF COURT RESOLUTION OF CONSUMER DISPUTES
In accordance with the legal regulation arising from the Act on Out-of-Court Resolution of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC, Floramicato d. o. o. does not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute that a consumer may initiate in accordance with the Act on out-of-court resolution of consumer disputes. For delivery the buyer chooses the address and the delivery method. In the “notes” field he can enter notes to the administrator of the online store. For the online store product delivery is carried out by Pošta Slovenije d. o. o. and UPS Adria [S] Ekspres d. o. o.
The delivery service reserves the right to verify the identity of the recipient in an appropriate way (inspection of personal or other documents), as this ensures that the ordered product is delivered to the right customer.
Approximate shipping time is 2 – 5 working days.
If the ordered products are not in stock, the shipping time can be extended by 10 – 14 days.
Your packages may be subject to customs and import duties of the country to which your order is shipped. These costs are the responsibility of the recipient.
If Floramicato is unable to deliver the ordered product because did not receive it – through no fault of its own -, Floramicato may withdraw from the contract. In this case Floramicato informs the customer immediately and offers him a similar product. If a similar product is not available or the customer does not want this product, Floramicato will immediately refund the payment for already paid products without compensation.
If the received products are damaged due to transport, please inform us immediately at firstname.lastname@example.org. Then Floramicato has the possibility to complain about the damage to the carrier or transport insurance company. If the customer does not provide a certificate of damage during transport, this will not affect his rights under the statutory warranty.
In order to fulfill orders as best as possible, Floramicato provides the relevant delivery service with the customer’s email address and phone number. This mediation is a mandatory part of the contractual relationship with Floramicato.
Price and delivery method

Payment is made in one of the following ways:

RIGHT TO WITHDRAW THE PURCHASE AND RETURN PRODUCT
The consumer has the right to withdraw from a contract, concluded at a distance – from an online purchase -, without giving reasons within 14 days.
The withdrawal period expires 14 days from the day when the consumer acquires physical possession of the product or acquires them – instead of the consumer by a third party, who is not the carrier and is determined for this purpose by the consumer. Or, in the case of partial delivery of individual pieces of product, from one order, the period expires 14 days from then, when the consumer acquires physical possession of the last piece of product or acquires it on behalf of the consumer by a third party, who is not the carrier and is determined by the consumer for this purpose.
In order to assert the right of withdrawal, the consumer must inform Floramicato d. o. o. with an statement, sent by post or email, about decision to withdraw from contract. For this purpose the consumer can optionally use the attached sample withdrawal form (here). Regardless of the form of cancellation the consumer must provide the company with a copy of the invoice or order number. In order for the deadline for withdrawing from the contract to be taken into account, it is sufficient that the notice regarding the exercise of the consumer’s right to withdraw from the contract is sent before the expiry of the withdrawal period from this contract.
EFFECTS OF WITHDRAWAL FROM THE AGREEMENT
If the consumer withdraws from this contract, the company shall return to him without undue delay and within 14 days from the date of receipt of the notice of withdrawal from contract all payments received, including delivery costs (except for additional costs due to the choice of a type of delivery that is not the most affordable standard form of delivery, offered by the company). Such return is made by the company using the same means of payment as was used for the original transaction, unless expressly agreed otherwise; in no case shall the consumer bear any costs as a result of this refund. The Company may withhold payment until the returned products are received or until the consumer sends proof that the products have been sent back, whatever occurs first. The consumer returns or hands over the products to the company that delivered the products to the consumer without undue delay within 14 days from the day on which the consumer notified the company of the withdrawal from the contract. The deadline is taken into account if the consumer sends the products back before the end of the 14-day period.
TERMS OF RETURN (restrictions on the right to withdraw from the contract).
The direct costs of returning the product are on the consumer side.
The consumer is only responsible for the reduced value of the product due to handling of the product, which is not absolutely necessary to determine its nature, properties and functioning. The products must be unused, undamaged and in the original packaging.
REFUNDS AND EXCHANGES
We really want our product to satisfy all your expectations. Therefore, if you are not completely satisfied with the product, we allow you to exchange it or get a refund.
Our return policy is simple.
- Purchased products can be returned 14 days after receiving the product. At the same time, you get a refund for the entire product or credit for an exchange or purchase of a new product.
- If you return the product after 14 days, you are entitled to a credit equal to the price of the returned product.
- The product must be returned in the same condition as it was received, including all packaging and original tags.
- A refund and merchandise credit will be issued the moment the return is received at our warehouse.
- The product you are returning must not show traces of cuts, teeth marks or saliva. Also the product must not be dirty or otherwise show signs of wear, as in this case we will not exchange it, refund the money or grant a credit.
- If you receive a damaged, defective or incorrect product, Floramicato d. o. o. pays the cost of shipping the replacement product. If we need the original product back, we will send you a prepaid shipping label or refund the shipping cost.
- For all other returns and exchanges, the buyer is responsible for the shipping cost to return the item. If the buyer requests an exchange of the item, he must also pay the shipping fee again for the new item at the valid price list.
Return or exchange process:
If you would like to return or exchange a product because it does not meet your expectations, please follow these steps:
- fill out the form that can be downloaded here:
- Pack the products in the same or similar packaging as they were sent to you. If using the original shipping packaging, please cover the previous shipping labels or other marks.
- Send the products back insured with a tracking number. Floramicato d. o. o. is not responsible for items lost in transit. Please save the tracking number until we send a replacement product or issue a credit.

- Receive a refund, credit, or exchange: We’ll email you when we receive your refund. Refunds will be made based on the original payment method. Please allow 7-10 business days for the credit to appear in your account. If you have requested a replacement product, we will ship the new product within 7 working days. We will ship the new products to you at your expense.
Returns of defective or incorrect products
To return a product that is damaged or was sent to you in error, please follow these steps:
- Request a prepaid shipping label: contact customer service. We will send you a prepaid shipping label or issue a callsign for UPS to pick up the package.
- Complete the return form:

Definition of factual error.
The error is real:
- if the product does not have the properties, necessary for its normal use;
- if the product does not have the properties required for the specific use for which the buyer is purchasing it, but which the seller was aware of or should have been aware of;
- if the product does not have the properties and features that were expressly or tacitly agreed or prescribed;
- if the supplier has delivered a product that does not match the sample or model, unless the sample or model has been shown for notification purposes only.
Product adequacy check
The suitability of the product for normal use is assessed against ordinary products of the same type and taking into account any statements by the seller about the characteristics of the products made by the seller or the manufacturer, in particular through advertising, product presentation or indications on the products themselves.
Enforcement of error
The buyer must notify the provider of any material defect, at his own expense, within the deadline.
The notification must contain a precise description of the error. The buyer must allow the provider to inspect the product.

VALIDITY OF THE OFFER
When purchasing, the prices apply at the moment of order confirmation. All prices include VAT. Prices can change without prior notice. Prices only apply to purchases in the Floramicato online store and may differ from regular prices. We reserve the right to change technical descriptions and configurations without prior notice. Images can only be symbolic and do not always reflect the actual situation.
ARCHIVING OF AGREEMENT
The contract concluded between the customer and the seller is archived at the address Floramicato d. o. o., Štuki 41, 2250 Ptuj, Slovenia. The buyer can obtain a copy by requesting it by email to: email@example.com.
The promo code, which is limited in time, brings various advantages when purchasing.
Codes can only be used for items produced by Floramicato d. o. o.
Using the promo code:
select the items you want to buy and add them to the cart. When you have finished adding items to your cart, continue by clicking the Checkout button. Choose the delivery method, specify the delivery address and choose the payment method, enter the promo code in the Gift voucher, promo code or discount code field and confirm the entry by clicking the Apply button.
Only one promo code can be used in each purchase (for example: when ordering 2 items, you can use a maximum of 1 promo code at the same time).
When you enter the promo code, the value of the promo code is automatically deducted from the price of your order in the last step – Order Summary. There remains an amount that still needs to be settled.
The combination of several benefits or different types of benefits (discount code, promo code and bonus) within the same order is not possible.
PROTECTION OF PERSONAL DATA

1. a) Online order processing
Personal data obtained during online ordering and/or registration (name, surname, postal address (primary and delivery address), email address, telephone number, time and date of registration, archive of communication, related to online purchase and other data, obtained during registration, such as information about animals of interest to the user, popular method of notification, login password and information on purchases made) are used to process the user’s order and fulfill the purchase or order (also sending offers, invoices and other information, related to the order) and other necessary communication with the user. Registration makes it easier for the user to track past purchases and shorten the purchase process. The data obtained for this purpose are kept until the fulfillment of the contractual obligation and the expiry of the limitation period (based on legitimate interest), or cancellation, deregistration or request for deletion in accordance with the current Act on the Protection of Personal Data and the Regulation on the Protection of Personal Data.
When the provision of personal data is necessary for the conclusion and performance of the contract, you must provide personal data; in case you do not provide personal data, Floramicato d. o. o. will not be able to fulfill the order, because we don’t have the necessary information.
The basis for the processing of personal data according to this point is the conclusion and implementation of a contract, concluded with an online purchase.
- b) Answers by online form
When using the online form on the floramicato.com website, the data (name, surname, e-mail address and phone number) are used to respond to the user. The data obtained for this purpose is kept for the duration of the processing and for a maximum 3 months after the withdrawal of consent for data processing.
The basis for the processing of personal data according to this point is the individual’s consent to communication by contact form.
- c) Sending electronic messages
When signing up for electronic news on the floramicato.com website, Floramicato d. o. o. used personal data (name, surname, e-mail address, IP address, in the case of a registered user, address, telephone number and place of registration) provided by the user for the purpose of sending electronic messages (news, advertising messages, notifications about ongoing promotions, etc.). Data obtained for this purpose are kept until cancellation, deregistration or request for deletion in accordance with the current Act on the Protection of Personal Data and the Regulation on the Protection of Personal Data, or until the purpose for which the data was collected is achieved.
The basis for the processing of personal data is the consent of the individual to receive e-news.
1. d) Direct marketing
Personal data (name, surname, postal address, telephone, e-mail address and other data, provided during registration) are used for direct marketing purposes: advertising, segmentation and profiling for the purpose of personalized advertising, surveys and for remarketing (targeted advertising) by web browsers and social networks. The data obtained for this purpose is kept for the duration of the processing and for a maximum of 3 months after the withdrawal of consent for data processing.
The basis for the processing of personal data is the individual’s consent to the processing of data for direct marketing.
- e) Analyses of purchasing habits
Personal data (name, surname, postal address, telephone, e-mail address and other data, provided during registration) and data on purchases made are used to analyze purchases and purchasing habits. In order to provide a better service and offer, to help with business and for profiling users and automated decision-making to ensure a better online user experience and send personalized offers. The data obtained for this purpose are kept for the duration of the processing and for a maximum of 3 months after the withdrawal of the consent for data processing for this purpose.
The basis for the processing of personal data is the individual’s consent to the processing of data for the analysis of purchasing habits.
The user can request access to the data held by Floramicato d. o. o. at any time. He can also request correction, restriction or prevention of use for an individual purpose of processing, deletion or transfer of data and lodge an objection with Floramicato d. o. o. or application to the information officer. The user can be responsible for the processing of personal data, and also has the right to revoke consent to the processing of personal data.
Users of personal data
Only persons authorized by employee or contractual partners with whom the Floramicato d. o. o. has concluded appropriate contracts on the processing of personal data have access to personal data.
